  • Types of products sold:
    • New products: Professional stage lighting, cases, and accessories.
    • B-stock products: Fixtures used in trade shows, promo videos, and demonstrations.
      • CLASS B: Paint damage not visible from a distance of more than 4 meters, no dents, full mechanical functionality preserved.
      • CLASS C: Paint damage visible from a distance of more than 4 meters, slight dents, older versions of the product, loose hinges or other connections, no electronic defects.
  • Restrictions: No specific restrictions on the use or purchase of products.

5. Pricing and Payment

  • Accepted payment methods: Cards: Visa, MasterCard, AmericanExpress. Instant payments: Przelewy24, iDEAL, Bancontact, EPS, Trustly
  • Currency for transactions: Euro.
  • Pricing accuracy and errors policy: If a product is mistakenly listed at an incorrect price, Portman Lights Sp. z o.o. reserves the right to cancel orders placed at that price and notify the customer of the cancellation and correct price.
  • Inclusion of VAT and other taxes in prices: Prices are subject to VAT rates applicable to the country of purchase.

6. Shipping and Delivery

  • Shipping methods and carriers: International and national courier services or personal pickup.
  • Shipping regions: EEA, UK, Norway, Switzerland, and the Balkans.
  • Shipping costs and timeframes:
    • For international shipping handled by UPS, the rates are calculated automatically based on the total weight, dimensions and the destination country. 
    • For international shipping handled by DB Schenker, the rates are calculated based on the total weight of the order and the destination country:
      • Zone 1 countries (Austria, Belgium, Czech, Denmark, Estonia, Finland, Germany, Hungary, Latvia, Lithuania, Netherlands, Slovakia)
        • up to 200kg (1 palette) – €120
        • up to 400kg  (2 pallets) – €240 
        • above 400kg (3 and more pallets) – €360
      • Zone 2 countries (Croatia, France, Italy, Lichtenstein, Romania, Slovenia, Sweden):
        • up to 200kg (1 palette) – €180
        • up to 400kg  (2 pallets) – €360 
        • above 400kg (3 and more pallets) – €540
      • Zone 3 countries (Bosnia, Bulgaria, Greece, Ireland, Norway, Portugal, Serbia, Spain, Switzerland, UK):
        • up to 200kg (1 palette) – €240
        • up to 400kg  (2 pallets) – €480 
        • above 400kg (3 and more pallets) – €720
    • For domestic shipping in Poland handled by DHL or DPD courier services the rates are based on the weight of the order:
      • up to 5 kg – €5
      • up to 14,5 kg – €10
      • up to 30,5 kg – €30
      • up to 200 kg (Pallet) – €60
      • up to 400 kg (Pallet) – €120
      • above 400 kg (Pallet) – €170
    • Estimated time of dispatch by courier is 72 hours.
    • Personal pickup is free or charge. 
  • All deliveries from our store are subject to DAP (Delivered at Place) terms. Under DAP, the seller is responsible for delivering the goods to the specified destination, covering shipping costs and delivery charges. However, the buyer is responsible for any import duties, taxes, and other charges that may be incurred upon delivery. It is important for customers to be aware that these additional fees are not included in the purchase price and must be settled by the buyer upon receipt of the goods.
  • Handling of lost or damaged items: Packages are insured. Customers must report damaged items immediately within a maximum 2 days of receipt and provide photos of the damage.
  • Right of withdrawal period: No right of withdrawal period is provided for business customers (B2B). Returns and refunds are handled as per the terms outlined in our Return Policy.

7. Returns and Refunds

  • Return Policy:
    • Eligibility for Return: Products can be returned within 14 days of receipt, provided they are in original condition and packaging. B-stock and C-stock items must be returned in the same condition as described in the product listing.
    • Non-returnable Items: Items used for any commercial or private purpose cannot be returned. This includes items that have been damaged, altered, or used beyond what is necessary to determine their nature, characteristics, and functioning.
    • Return Process:
      • Contact Customer Service: To initiate a return, contact our customer service team at [email protected] with your order details, including the order number and the reason for the return.
      • Receive Return Authorization: Our customer service team will provide you with a return authorization number and instructions on how to return the item.
      • Prepare the Item for Return: Ensure the item is securely packed in its original packaging, including all accessories, manuals, and documentation. Clearly mark the return authorization number on the outside of the package.
      • Ship the Item: Ship the item to the address provided by our customer service team. We recommend using a trackable shipping method and purchasing shipping insurance, as we cannot guarantee receipt of your returned item.
    • Refund Process:
      • Once we receive and inspect the returned item, we will notify you of the approval or rejection of your refund.
      • If approved, the refund will be processed and a credit will automatically be applied to your original method of payment within 14 days. The refund will include the original purchase price minus any applicable restocking fees and shipping costs.
    • Restocking Fees: A restocking fee of up to 20% may be applied to returned items that are not in their original condition or missing parts. This fee will be deducted from the refund amount.
  • Damaged or Defective Items:
    • If you receive a damaged or defective item, please contact our customer service team immediately at [email protected]. Provide detailed photos of the damage or defect along with your order information.
    • We will work with you to resolve the issue promptly, including offering a replacement, repair, or refund, as applicable.

8. User Conduct

  • Acceptable use policy: Users are prohibited from using the website for illegal activities, posting harmful or offensive content, distributing spam, engaging in fraudulent transactions, using automated systems to access the website, or attempting to hack or disrupt the website.

9. Intellectual Property

Users may download and print entire pages or fragments of the website for personal use, provided that copyright and trademark rights are not infringed.     • New products: 24-month warranty.
    • B-stock products: 6-month warranty.
    • C-stock products: 1-month warranty.
    • The warranty does not include fuses, light sources, and other consumable parts.
  • Special considerations for used products: Used products are sold “as-is” with detailed descriptions and photos of their condition.

12. Governing Law and Dispute Resolution

  • Jurisdiction and governing law: These terms are governed by the laws of Poland. All disputes will be resolved in the courts of Poland.

13. Amendments

  • Policy on changes: Portman Lights Sp. z o.o. reserves the right to amend these terms and conditions at any time. Changes will be effective immediately upon posting on the website.
  • Notification process: Users will be notified of significant changes to the terms and conditions via email or a prominent notice on the website.

14. Customer Obligations

  • Accurate Information: Customers must provide accurate and complete information when placing orders. Any incorrect information provided by the customer that leads to additional costs (such as shipping to a wrong address) will be the responsibility of the customer.
  • Responsibility for Returns: Customers are responsible for ensuring that returned products are packaged securely to prevent damage during transit. We recommend using a trackable shipping service for returns.

15. Limitation of Liability

  • No Indirect Damages: Portman Lights Sp. z o.o. will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the use of the website or the purchase of products.
  • Maximum Liability: The maximum liability of Portman Lights Sp. z o.o. for any claim arising out of or relating to these terms and conditions or the purchase of products from the website will be limited to the amount paid by the customer for the products in question.

16. Force Majeure

  • Events Beyond Control: Portman Lights Sp. z o.o. will not be liable for any failure to perform, or delay in performance of, any of our obligations under these terms and conditions that are caused by events outside our reasonable control (Force Majeure Event).
  • Examples of Force Majeure Events: This includes, but is not limited to, acts of God, war, terrorism, strikes, lockouts, labor disputes, epidemics, pandemics, fire, flood, earthquake, natural disaster, governmental actions, or any other event that is beyond our control.

  • Severability Clause: If any provision of these terms and conditions is found to be invalid, illegal, or unenforceable by any court of competent jurisdiction, such provision will be deemed modified to the extent necessary to make it valid, legal, and enforceable. The remaining provisions of these terms and conditions will continue in full force and effect.

18. Entire Agreement

  • Entire Agreement: These terms and conditions constitute the entire agreement between customer and Portman Lights Sp. z o.o. with respect to your use of the website and the purchase of products, and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Portman Lights Sp. z o.o.
